1. Acceptance of Terms
By accessing or using AutoGuard Pro ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These terms apply to all users of the platform, including fleet managers, insurance brokers, security operators, and individual vehicle owners.
2. Description of Service
AutoGuard Pro is a comprehensive vehicle security and recovery platform that provides:
- Incident and panic reporting (theft, hijacking, accidents, medical)
- GPS location when you submit an incident (not continuous background tracking)
- Emergency coordination with security operations centres
- BOLO (Be On Lookout) alert distribution to operators
- Vehicle enrolment and fleet management
- Document packs and operational reporting (where enabled for your role)
3. User Accounts
3.1 Registration
To use the service, you must register for an account. You agree to:
- Provide accurate, complete, and current information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Notify us immediately of any unauthorized access
3.2 Account Approval
All registration requests are subject to review and approval by our operations team. We reserve the right to deny access to any applicant at our discretion.
3.3 Account Types
- Individual Client: Personal use for vehicle owners
- Fleet Manager: Business accounts for companies managing multiple vehicles
- Insurance Broker: Accounts for insurance professionals and brokerages
- Security Operator: Internal accounts for dispatch and monitoring personnel
4. Acceptable Use
4.1 Permitted Use
You may use the service only for lawful purposes and in accordance with these Terms.
4.2 Prohibited Activities
You agree NOT to:
- Submit false, fraudulent, or misleading incident reports
- Use the service for any unlawful or unauthorized purpose
- Attempt to gain unauthorized access to any part of the system
- Interfere with, disrupt, or overload the service or servers
- Share your account credentials with unauthorized persons
- Use the service to make false emergency claims
- Copy, modify, or distribute any part of the service
- Reverse engineer or decompile the application
- Use automated systems to access the service without permission
5. Emergency Services
5.1 Panic and Emergency Features
The platform includes panic buttons and emergency alert features designed for genuine emergencies only.
5.2 Misuse of Emergency Features
Misuse of emergency features may result in:
- Immediate account suspension or termination
- Legal action and prosecution
- Liability for emergency response costs
- Reporting to law enforcement authorities
5.3 Response Disclaimer
While we strive to respond to all emergency alerts promptly, response times may vary based on location, availability of resources, and other factors beyond our control.
6. Data and Privacy
6.1 Data Collection
We collect only what is needed to provide the service. See our Privacy Policy for full detail. Summary:
- Account: Name, email, phone, company/broker details (web registration); password stored encrypted
- Profile (mobile): Optional emergency contacts, medical information for emergencies, driver's licence photo
- Vehicles: Registration, VIN, photos, tracker details, garaging address on the vehicle record
- Incidents: GPS and address at time of report, photos, voice notes, and related evidence
- Technical: Security logs (IP, browser/app), push notification tokens if you enable alerts
We do not collect ID numbers or dates of birth on web registration, and we do not maintain a general travel-history log.
6.2 Data Protection
Your personal data is processed in accordance with the Protection of Personal Information Act (POPIA) and our Privacy Policy.
6.3 Data Sharing
We may share data with:
- Law enforcement when legally required
- Emergency services during active incidents
- Insurance partners (with your consent)
- Service providers who assist our operations
6.4 Data Retention
We retain your data while your account is active. After an account is closed (deactivated), we retain certain records for up to five years for legal and operational purposes, then delete or anonymise personal data as described in the Privacy Policy. Immediate erasure may be requested subject to legal obligations.
7. Intellectual Property
All content, trademarks, logos, and intellectual property in the service are owned by AutoGuard Pro or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the service for its intended purpose.
8. Limitation of Liability
8.1 Service Disclaimer
AutoGuard Pro provides security monitoring and response coordination services. We do not guarantee:
- Prevention of vehicle theft, hijacking, or damage
- Recovery of stolen vehicles
- Immediate response to all alerts
- Uninterrupted or error-free service
8.2 Limitation
To the maximum extent permitted by law, AutoGuard Pro's liability is limited to the amount paid by you for the service in the preceding 12 months. We shall not be liable for any indirect, incidental, special, or consequential damages.
9. Indemnification
You agree to indemnify and hold harmless AutoGuard Pro, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these Terms.
10. Termination
10.1 By User
You may close your account at any time by contacting our support team.
10.2 By AutoGuard Pro
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform.
11. Changes to Terms
We may update these Terms from time to time. We will notify users of significant changes via email or through the platform. Continued use of the service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
